Terms of Service

1. Acceptance of Terms

These Terms of Service (the "Terms") govern your access to and use of services operated by Lynx Gaming Systems and its affiliates ("Lynx Gaming Systems," "Lynx," "we," "us," or "our"), collectively the "Services." "Lynx Parties" means Lynx Gaming Systems, its affiliates, owners, officers, directors, employees, contractors, licensors, and service providers.

By accessing or using the Services, you agree to these Terms, the Privacy Policy, the AML and Sanctions Compliance Policy, the Trademark Policy, and any additional rules or product terms that apply to specific features, promotions, or games. If you do not agree, do not use the Services.

2. Eligibility and Lawful Use

You may use the Services only if:

• you are at least 18 years old, or older if the law where you are located requires a higher age for the relevant activity;
• you are legally able to enter into a binding agreement;
• your use of the Services is lawful where you are located and where you access the service;
• you are not a sanctioned, blocked, suspended, or otherwise prohibited person; and
• you are not using the Services on behalf of a person who is barred from using them.

Certain games, paid-entry features, or withdrawal features may be unavailable in some jurisdictions. Lynx may use geolocation, device signals, KYC, and other controls to enforce these restrictions. You may not access or attempt to access restricted features from a prohibited location, including through a VPN, proxy, or concealment tool.

3. Accounts, Social Login, and Wallets

You may be required to create an account or sign in using a third-party identity provider such as Google, X, Discord, or another provider supported by Lynx. Your account is personal to you. You may not sell, transfer, share, or lend your account, allow another person to use it, or create accounts on behalf of others without Lynx's written permission. You must provide accurate and current information and promptly update it if it changes.

If you link an external wallet, you represent that you control that wallet or are authorized to use it. External wallets are controlled by you or your wallet provider, not by Lynx. You are solely responsible for protecting your wallet credentials, recovery phrase, email account, device, PIN, and linked sign-in methods.

4. Service Description; Off-Chain and On-Chain Functions

Lynx provides a gaming platform with account infrastructure, social and wallet authentication, off-chain game operation and ledgering, blockchain funding workflows, supported withdrawal features, and related support and compliance processes.

Gameplay, match results, scoring, account balances, credits, and other platform records are maintained off-chain unless Lynx expressly states otherwise. A blockchain transaction does not itself guarantee that credits will be posted, that a game entry will be accepted, or that a withdrawal request will be accepted or completed. Lynx may require blockchain confirmations, internal reconciliation, fraud review, compliance review, and other checks before crediting, debiting, or settling an account.

If there is a discrepancy between on-chain events and Lynx's off-chain account or gameplay records, Lynx's internal records govern unless Lynx determines a manifest error occurred or applicable law requires otherwise.

5. Game Credits, Points, Funding, and Supported Withdrawals

5.1 Points.

Points are gameplay metrics only. Points have no cash value, are not legal tender, are not transferable, and are not redeemable for cash or digital assets.

5.2 Game Credits.

Game Credits are off-chain bookkeeping entries recorded by Lynx for limited use within the Services. Game Credits are not cash, legal tender, deposits, bank accounts, securities, or blockchain tokens. Game Credits do not represent or give you any ownership interest in, or claim to, any specific segregated wallet, reserve, smart contract balance, or digital asset held, controlled, or used by Lynx. Game Credits are non-transferable except as expressly permitted by Lynx.

5.3 Funding Activity.

You may initiate blockchain transfers of supported digital assets through supported wallets, addresses, interfaces, or smart contract flows made available in connection with the Services. Lynx may, after required confirmations, reconciliation, and review, reflect corresponding Game Credits in your off-chain account records. Lynx does not guarantee any 1:1 fiat value, 1:1 ETH value, exchange rate, conversion ratio, or parity between any blockchain transfer and any Game Credits, Points, or displayed amount.

5.4 Supported Withdrawals.

Where Lynx makes available a Supported Withdrawal feature and applicable law permits, an eligible user may submit a withdrawal request or initiate a supported user-initiated on-chain withdrawal flow using a supported wallet. Any Supported Withdrawal is conditional and subject to wallet compatibility, linked-wallet validation, original funding-source or approved destination rules, gameplay integrity review, fraud review, sanctions screening, AML review, gas fees, network availability, smart contract conditions, treasury controls, applicable law, and any applicable platform validation, signature checks, or smart-contract preconditions. Lynx may require withdrawals to be made only to a previously linked, verified, or otherwise approved wallet or destination.

5.5 No On-Demand Right; No Specific Asset Entitlement.

Game Credits do not entitle you to immediate payout on demand, to any specific blockchain asset, or to any specific rail, reserve, or treasury source. Any Supported Withdrawal amount, if allowed, may differ from the quantity or market value of digital assets previously transferred to or from any supported blockchain interface or smart contract.

5.6 Wallet Responsibility.

You are solely responsible for your wallet, wallet credentials, private keys, recovery phrases, selected network, destination address, transaction parameters, and any third-party wallet or interface you choose to use. Lynx does not control your personal wallet or private keys and is not responsible for wallet-provider failures, loss of wallet access, wrong-address transfers, unsupported networks, or user-input errors.

5.7 Adjustments; Error Correction; Compliance Controls.

Lynx may correct manifest errors, void gameplay or balances affected by bug, exploit, collusion, fraud, or malfunction, reverse provisional credits, and make other reasonable adjustments required to protect users, preserve game integrity, comply with law, or enforce these Terms.

6. Fees, Gas Costs, and Taxes

You are responsible for any gas fees, blockchain fees, network costs, bank fees, exchange fees, or third-party fees associated with your use of the Services. You are also responsible for determining, reporting, and paying any taxes arising from your use of the service, except for taxes imposed on Lynx's income.

7. Acceptable Use and Gameplay Integrity

You may not:

• violate law or these Terms;
• commit fraud, theft, money laundering, sanctions evasion, or other unlawful conduct;
• cheat, collude, use bots, scripts, automation, exploits, latency abuse, reverse engineering, packet manipulation, or unauthorized software;
• intentionally lose, transfer value, chip dump, or otherwise manipulate gameplay to move value between accounts;
• create multiple accounts to evade limits, bans, or controls;
• misrepresent identity, age, jurisdiction, beneficial ownership, or wallet control;
• scrape, overload, probe, or disrupt Lynx systems except as expressly authorized in writing;
• interfere with Lynx treasury, withdrawal, security, compliance, or anti-cheat systems; or
• infringe another person's privacy, publicity, intellectual property, or other rights.

Lynx may void matches, results, balances, or rewards affected by manifest error, exploit, abuse, collusion, cheating, or technical malfunction.

8. Compliance and Investigation Rights

Lynx may monitor activity, review account, gameplay, wallet, funding, withdrawal, device, geolocation, IP, sanctions, and transaction data, request additional information, screen wallets and counterparties, reject or delay transactions, limit account features, freeze or suspend access, void affected gameplay results, and cooperate with regulators, law enforcement, courts, payment partners, and compliance providers where appropriate. You agree to provide truthful, complete, and timely information reasonably requested for security, fraud, sanctions, AML, gameplay-integrity, or legal review.

9. Third-Party Services

Lynx may rely on third-party identity providers, wallets, blockchain infrastructure, hosting providers, analytics tools, payment or treasury providers, and other vendors. Lynx is not responsible for the acts, omissions, downtime, security failures, or policy changes of third-party services that Lynx does not control. Your use of third-party services may be subject to separate terms and privacy policies.

10. Intellectual Property

Lynx and its licensors own all right, title, and interest in and to the Lynx service, including software, interfaces, branding, designs, content, audiovisual materials, game mechanics, account systems, and related intellectual property, except where third-party rights apply. Your use of Lynx does not transfer ownership of any Lynx intellectual property to you. Trademark use is governed by the Trademark Policy.

11. Usernames, Content, and Feedback

If Lynx permits you to submit usernames, profile images, chat content, support materials, bug reports, or other content, you represent that you have the necessary rights and that it does not violate law or another person's rights. You grant Lynx a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and use submitted content solely as needed to operate, secure, moderate, and improve the service. If you provide ideas, suggestions, or feedback, Lynx may use them without restriction or compensation unless a separate written agreement states otherwise.

12. Blockchain and Digital Asset Risks

You acknowledge and accept that blockchain transactions may be public, irreversible, delayed, censored, reordered, or expensive. Smart contracts, wallets, nodes, bridges, relayers, RPC providers, oracles, and other infrastructure may fail or behave unexpectedly. Asset prices, liquidity, slippage, and gas costs may change rapidly. Lynx does not guarantee any particular market price, exchange rate, conversion ratio, parity, 1:1 fiat value, or 1:1 ETH value for any digital asset, Game Credit balance, Point balance, or displayed amount. Lynx is not responsible for market volatility, unsupported assets, chain forks, chain reorganizations, wallet-provider failures, user input errors, loss of wallet access, or sending assets to unsupported addresses or networks.

13. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. LYNX AND ITS AFFILIATES, OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. Lynx does not guarantee uninterrupted service, error-free operation, successful withdrawal timing, profitable gameplay, or the legality of your participation in every jurisdiction. Lynx does not provide legal, tax, financial, investment, or gambling-law advice.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, LYNX AND ITS AFFILIATES, OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OPPORTUNITY, DIGITAL ASSETS, OR BUSINESS INTERRUPTION ARISING OUT OF OR RELATING TO THE SERVICES. LYNX'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO LYNX FOR THE SPECIFIC FEATURE GIVING RISE TO THE CLAIM DURING THE 12 MONTHS BEFORE THE EVENT; OR (B) THE MINIMUM AMOUNT REQUIRED BY APPLICABLE LAW.

15. Indemnification

You agree to defend, indemnify, and hold harmless Lynx and its affiliates, owners, officers, directors, employees, contractors, licensors, and service providers from and against claims, losses, liabilities, damages, judgments, penalties, fines, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to your use of the Services, your violation of these Terms or applicable law, your fraud, cheating, collusion, or misuse of the service, or your infringement or violation of another person's rights.

16. Suspension and Termination

Lynx may suspend, restrict, or terminate some or all of your access to the Services at any time, with or without notice, where Lynx reasonably believes it is necessary for security, fraud prevention, AML, sanctions compliance, legal compliance, operational protection, maintenance, investigation, or enforcement of these Terms. Upon termination, your right to use the Services stops immediately. Any provisions that by their nature should survive termination will survive.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Services shall be resolved by binding arbitration administered by JAMS under its applicable rules. The seat of arbitration is Austin, Texas, unless the parties agree otherwise.

Class Action & Jury Trial Waiver. TO THE FULLEST EXTENT PERMITTED BY LAW, DISPUTES MUST BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. YOU AND WE WAIVE ANY RIGHT TO A JURY TRIAL.

18. Changes to These Terms

Lynx may modify these Terms from time to time. Updated Terms become effective when posted unless a different effective date is stated. By continuing to use the Services after updated Terms take effect, you agree to the revised Terms to the extent permitted by law.
